Kbiotech may offer you benefits and award privileges for your participation and/or contribution to this Site. The benefits and privileges provided do not create an employee, agency or independent contractor relationship between yourself and Kbiotech, and you may not present yourself as a spokesperson for Kbiotech without written expressed and specific ability to do so as designated by and under the discretion of Kbiotech.

Prohibited Uses

Leasing, selling, copying, sublicensing, transferring, or assigning any information, intellectual property, goods, or services provided on the site using the site for any illegal purpose gaining unauthorized access to the company’s data or the data of other users altering, modifying, adapting, reverse engineering, decompiling, disassembling, or hacking the company’s intellectual property altering or modifying another website to falsely imply that it is associated with the company’s website,

using or exporting the company’s information, products, or services in violation of Swiss export laws and regulations violating anyone else’s legal rights (for example, privacy rights) or any laws (for example, copyright laws) in the user’s jurisdiction using the website or the company’s services to transmit content that could be deemed unlawful, threatening, harassing, racist, abusive, libelous, pornographic, vulgar, defamatory, obscene, indecent, or otherwise inappropriate, including any messages constituting or encouraging criminal conduct breaching, or attempting to breach, the website’s security systems enabling third parties to violate the Terms of Use.

User Conduct

You represent, warrant and agree that no materials of any kind submitted through your account or otherwise posted, transmitted, or shared by you on or through the Kbiotech will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material.

Reporting Copyright and Other Intellectual Property Violations

Kbiotech abides by all relevant copyright laws. We review all claims of copyright infringement, as well as other intellectual property violations, we receive. We will remove all content deemed to have been posted or distributed in violation of any such laws.

To report such a violation, please provide Company with as much detail as possible, including the following:

Information about the copyrighted work: description, information about where the work is protected, information about the current owner of the work, the physical or electronic signature of the copyright owner or a person authorized by the copyright owner to act on its behalf;

Information about the allegedly infringing work: description of the infringing material and any other information necessary to assist the Company in locating the allegedly infringing work;

Limitation of Liability

IN NO EVENT WILL ANY OF THE KBIOTECH PARTIES BE LIABLE FOR (A) ANY INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES  WITHOUT LIMITATION, THOSE RESULTING FROM LOSS OF REVENUES, LOST PROFITS, LOSS OF GOODWILL, LOSS OF USE, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES), ARISING OUT OF OR IN CONNECTION WITH THIS WEBSITE (INCLUDING, WITHOUT LIMITATION, USE, INABILITY TO USE, OR THE RESULTS OF USE OF THIS WEBSITE), WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY AND EVEN IF ANY KBIOTECH PARTY HAS BEEN ADVISED (OR SHOULD HAVE KNOWN) OF THE POSSIBILITY OF SUCH DAMAGES.

To the extent that any Kbiotech Party may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of the Kbiotech Party’s liability shall be the minimum permitted under such applicable law.

Other Agreements; Software, Services or Access

Kbiotech may provide products (such as hardware or software), services (such as software subscription services, hardware maintenance or repair or software maintenance, installation, or training) or access via This Website under the terms of a separate agreement between You and Kbiotech, such as a license agreement or separate terms of sale and warranty terms (each, an “Other Agreement”). Kbiotech’s obligations regarding any product, service, or access that it makes available to You under any Other Agreement shall be governed solely by the Other Agreement under which such product, service or access is provided and These Terms shall not be deemed or construed to alter the terms of any such Other Agreement. If there is an inconsistency between These Terms and any Other Agreement, the Other Agreement will control.

For example, the use of any software that is made available to download from the Kbiotech Websites (“Software”) is governed by the terms of the end user license agreement, if any, that accompanies or is included with the Software (“License Agreement”). You may not install any Software that is accompanied by or includes a License Agreement unless You first have agreed to the License Agreement. If there is no License Agreement, then These Terms will govern Your use of that Software.
